         Um eine Korrektur eines Vergabeverfahrens zu erreichen, kann ein Nachprüfungsantrag bei der unter VI.4.1) genannten Stelle gestellt werden, solange durch den Auftraggeber ein wirksamer Zuschlag noch nicht erteilt worden ist. Ein wirksamer Zuschlag kann erst erteilt werden, nachdem der Auftraggeber die unterlegenen Bieter über den beabsichtigten Zuschlag informiert hat und die gem. § 19 EU, Abs. 2 VOB/A 2016 vorgeschriebene Informationsfrist vergangen ist. Vor der Antragstellung muss der Bieter den Vergaberechtsverstoß innerhalb von 10 Kalendertagen gegenüber dem Auftraggeber gerügt haben. Bei einem Vergaberechtsverstoß, der auf Grund der Bekanntmachung erkennbar war, muss die Rüge innerhalb der Angebotsfrist erfolgen. Bei Nichtabhelfen der Rüge durch die Vergabestelle wird auf die Frist nach § 160 Abs. 3 Nr. 4 GWB verwiesen.
