            Ein zulässiger Nachprüfungsantrag bei der unter VI.4.1. genannten Vergabekammer kann bis zur wirksamen Zuschlagserteilung gestellt werden. Eine wirksame Zuschlagserteilung ist erst möglich, wenn der Auftraggeber die unterlegenen Bieter über den Grund der vorgesehenen Nichtberücksichtigung ihres Angebots und den Namen des Bieters, dessen Angebot angenommen werden soll, in Textform informiert hat und seit der Absendung der Information 15 Kalendertage (bei Versand per Telefax oder auf elektronischem Weg: 10 Kalendertage) vergangen sind.

            Ist die Zuschlagserteilung unwirksam, kann ein zulässiger Nachprüfungsantrag innerhalb von 30 Kalendertagen ab Veröffentlichung dieser Bekanntmachung bei der unter VI.4.1. genannten Vergabekammer gestellt werden.

            Ein Nachprüfungsantrag ist unzulässig, soweit

            — der Bieter den gerügten Vergaberechtsverstoß schon im Vergabeverfahren erkannt und gegenüber dem Auftraggeber nicht innerhalb einer Frist von 10 Kalendertagen gerügt hat,

            — Vergaberechtsverstöße, die aufgrund der in IV.2.1) angegebenen Auftragsbekanntmachung erkennbar sind, nicht spätestens bis zum Ablauf der in dieser Auftragsbekanntmachung genannten Bewerbungsfrist gerügt worden sind, oder

            — Vergaberechtsverstöße, die erst in den Vergabeunterlagen erkennbar sind, nicht spätestens bis zum Ablauf der in der Auftragsbekanntmachung genannten Bewerbungsfrist genannten Frist gerügt werden.

            Teilt der Auftraggeber einem Bieter mit, dass er einer Rüge nicht abhelfen will, so kann der Bieter wegen dieser Rüge nur innerhalb von 15 Kalendertagen ab Eingang der Mitteilung des Auftraggebers einen zulässigen Nachprüfungsantrag stellen.
