         Die Vergabestelle weist ausdrücklich auf die Rügeobliegenheit der Unternehmen/ Bewerber/ Bieter sowie auf die Präklusionsregelung gem. § 160 Abs. 3 S. 1 Nr. 1 bis Nr. 4 GWB hinsichtlich der Behauptung von Verstößen gegen die Bestimmungen über das Vergabeverfahren hin. Solange ein wirksamer Zuschlag (Vertragsabschluss) noch nicht erteilt ist, kann als Rechtsbehelf ein Nachprüfungsantrag bei der unter 4.1 genannten Stelle gestellt werden. Bewerber und Bieter müssen Vergabeverstöße bei der unter I.1 genannten Vergabestelle rügen, bevor sie einen Nachprüfungsantrag stellen.
