            Genaue Angaben zu den Fristen für die Einlegung von Rechtsbehelfen:

            Gemäß § 160 Abs. 3 Satz 1 Nr. 4 Gesetz gegen Wettbewerbsbeschränkungen (GWB) muss ein Nachprüfungsantrag spätestens 15 Kalendertage nach Eingang der Mitteilung des Auftraggebers, einer Rügenicht abhelfen zu wollen, bei der angegebenen Vergabekammer eingereicht werden.

            Ein Nachprüfungsantrag ist zudem unzulässig, wenn der Antrag erst nach Zuschlagserteilung zugestellt wird (§168 GWB).

            Die Zuschlagserteilung ist möglich 10 Kalendertage nach Absendung der Information über die Vergabeentscheidung per Fax oder E-Mail und 15 Kalendertage nach Absendung der Information über die Vergabeentscheidung per Post, wobei die Frist jeweils unabhängig vom Zugang der Information beim

            Betroffenen Bewerber oder Bieter am Tag nach Absendung der Information beginnt (§ 134 GWB).

            Die Zulässigkeit eines Nachprüfungsverfahrens setzt ferner voraus, dass erkannte Vergabeverstöße innerhalb der in § 160 Abs. 3 Nr. 1 GWB genannten Fristen gegenüber dem Auftraggeber gerügt wurden.
