         Die Lieferung der HKN erfolgt auf ein Konto der BVG oder eines beauftragten Dienstleisters im Herkunftsnachweisregister des Umweltbundesamtes, D-Dessau-Roßlau (UBA) oder eines vergleichbaren ausländischen Registers welches Mitglied bei AIB (association of issuing bodies) ist.

         Durch den Auftraggeber (AG) werden mit den qualifizierten Bietern Rahmenvereinbarungen abgeschlossen, in denen die Verfahrensweise des Verhandlungsverfahrens geregelt ist. Die Beschaffung von HKN soll für die Beschaffungsmonate Januar 2017 bis Dezember 2018 erfolgen. Die Menge insgesamt beträgt ca. 454GWh pro Jahr. Der AG beabsichtigt, die Bedarfsmengen an Herkunftsnachweisen auf Basis von monatlichen/2-monatlichen Bedarfsmengen zu beschaffen.

                                 Die Unwirksamkeit des erteilten Auftrags kann nur festgestellt werden, wenn sie im Nachprüfungsverfahren innerhalb von 30 Kalendertagen nach der Information der betroffenen Bieter und Bewerber durch den öffentlichen Auftraggeber über den Abschluss des Vertrags, jedoch nicht später als 6 Monate nach Vertragsschluss geltend gemacht worden ist. Hat der Auftraggeber die Auftragsvergabe im Amtsblatt der Europäischen Union bekannt gemacht, endet die Frist zur Geltendmachung der Unwirksamkeit 30 Kalendertage nach Veröffentlichung der Bekanntmachung der Auftragsvergabe im Amtsblatt der Europäischen Union.
