         Es wird darauf hingewiesen, dass bei Beanstandungen im Hinblick auf das hiesige Vergabeverfahren die Bieter Verstöße gegen Vergabevorschriften, die sie erkannt haben, gegenüber der Vergabestelle unverzüglich – d. h. abhängig von den jeweiligen Umständen des Einzelfalls maximal 10 bis 14 Tage – zu rügen haben und weiterhin Verstöße gegen Vergabevorschriften, die aus der Bekanntmachung oder den Vergabeunterlagen erkennbar sind, von den Bietern spätestens bis zum Ablauf der Frist zur Angebotsabgabe gegenüber der Vergabestelle zu rügen sind (vgl. § 160 Abs. 3 Nr. 1-3 GWB), damit die Bieter für den Fall, dass der Rüge nicht abgeholfen wird, ein Nachprüfungsverfahren vor der Vergabekammer anstreben können.

         Ergeht eine Mitteilung des Auftraggebers, der Rüge nicht abhelfen zu wollen, kann der Bieter wegen Nichtbeachtung der Vergabevorschriften ein Nachprüfungsverfahren nur innerhalb von 15 Kalendertagen nach Eingang vor der Vergabekammer beantragen.
