         Architektenleistungen (LP 1-9) gem. HOAI § 34 für die Erhöhung der Zügigkeit von jeweils einem auf zwei Züge für die Grundschule „Schloss Benrath“ und „St. Cäcilia“ in Benrath, Düsseldorf. Die Grundschulen Schloss Benrath und St. Cäcilia sollen jeweils um einen Zug erhöht werden, der zusätzliche Raumbedarf gem. Raumprogramm beträgt ca. 1 712 m2 Nutzfläche / 2 712 m2 BGF. Beide Schulen teilen sich das Gebäude an der Erich-Müller-Str. 31. Architektenleistungen gem. HOAI § 34. Zu erbringende Leistungsphasen: LP 1-9 gemäß HOAI 2013. Die Beauftragung der Leistung erfolgt stufenweise und in Abhängigkeit von bauherrenseitigen Entscheidungsgremien bezüglich der Weiterführung des Projektes. Die Stufen stellen sich bei der Beauftragung wie folgt dar: Stufe 1 (LP 1-2), Stufe 2 (LP 3), Stufe 3 (LP 4, LP 5-6 in Teilen), Stufe 4 (LP 5-6 in Teilen, LP 7-8), Stufe 5 (LP 9).

         Nach § 135 Abs. 2 GWB endet die Frist, mit der die Unwirksamkeit eines Vertrages mit einem Nachprüfungsverfahren geltend gemacht werden kann, 30 Kalendertage ab Kenntnis des Verstoßes, der zur Unwirksamkeit des Vertrages führt, jedoch nicht später als sechs Monate nach Vertragsschluss oder im Falle der Veröffentlichung der Bekanntmachung der Auftragsvergabe im Supplement zum Amtsblatt der Europäischen Union 30 Kalendertage nach dieser Veröffentlichung.

         Nach § 160 Abs. 3 Nr. 1 bis 4 GWB ist der Antrag auf Einleitung eines Nachprüfungs-verfahrens unzulässig, soweit

         — der Antragsteller den gerügten Verstoß gegen Vergabevorschriften im Vergabeverfahren erkannt und gegenüber dem Auftraggeber nicht unverzüglich gerügt hat,

         — Verstöße gegen Vergabevorschriften, die aufgrund der Bekanntmachung erkennbar sind, nicht spätestens bis Ablauf der in der Bekanntmachung benannten Frist zur Angebotsabgabe oder zur Bewerbung gegenüber dem Auftraggeber gerügt werden,

         — Verstöße gegen Vergabevorschriften, die erst in den Vergabeunterlagen erkennbar sind, nicht spätestens bis zum Ablauf der in der Bekanntmachung benannten Frist zur Angebotsabgabe oder zur Bewerbung gegenüber dem Auftraggeber gerügt werden,

         — mehr als 15 Kalendertage nach Eingang der Mitteilung des Auftraggebers, einer Rüge nicht abhelfen zu wollen, vergangen sind.
