         Die GEWOFAG Wohnen GmbH beabsichtigt in München, Stadtbezirk Neuhausen-Nymphenburg bei sieben Bestandsgebäuden eine umfassende energetische Modernisierungsmaßnahme durchzuführen. Die Gebäude sind im Eigentum der GEWOFAG Wohnen GmbH. Sämtliche Mietwohnblöcke befinden sich auch während der operativen Umsetzung in voll bewohntem Zustand. Die Gebäude sind in bauzeittypischer - Baujahr 1956 - 1967 - Ziegelbauweise mit Ziegeldach oder Flachdach errichtet. Der gesamte Bestand ist mittlerweile an die Fernwärme angeschlossen.

         Folgende Arbeiten sind im Rahmen der Sanierungsmaßnahme durchzuführen (die Aufzählung ist nicht abschließend):

         — Wärmedämmfassade, - Malerarbeiten, - Dämmung Unterseite Kellerdecke im Bereich der genutzten Mieterkellerabteile,

         — Speicher Dämmung auf Fußboden, - Fenstertausch, - Betonsanierungsarbeiten an Balkonen und Loggien,

         — Allgemeine Spengler-, Schlosser und Dachdeckungsarbeiten, - Allgemeine Fliesen-, Naturstein- und Schreinerarbeiten.

         Sieht sich ein am Auftrag interessiertes Unternehmen durch die Nichtbeachtung von Vergabevorschriften in seinen Rechten verletzt, ist der Verstoß innerhalb einer Frist von 10 Kalendertagen gegenüber dem Auftraggeber zu rügen (§160 Abs. 3 Nr. 1 GWB). Verstöße, die aufgrund der Bekanntmachung oder der Vergabeunterlagen erkennbar sind, müssen spätestens bis zu der in der Bekanntmachung genannten Frist zur Bewerbung oder zur Angebotsabgabe gegenüber dem Auftraggeber gerügt werden (§ 160 Abs. 3 Nr. 2 und 3 GWB).
