Vattenfall GmbH intends to sell 100 % of its shares in Vattenfall Europe Netcom GmbH. Vattenfall Europe Netcom GmbH is an integrated full-scope service and engineering provider of secure and high availability telecommunication systems and solutions (e.g alarm tracking systems and smart metering communication services). Core business market is operation of critical infrastructures of the energy industry and metropolitan network operators. The company generated 27 600 000 EUR in revenues in 2016 with 111 dedicated and highly skilled employees. The company provides services to several Vattenfall group companies as well as to external customers. The service offering comprises wide-area networks, voice services, safety and security services, customized communication solutions and leased lines and infrastructure services.
Precise information on deadline(s) for review procedures:
Deadlines for the submission of an application for review are based on Section 160 Subsection 3 GWB (German Act against restraints on competition): “The application shall be inadmissible if:
1— the applicant has recognised the claimed violation of contract-awarding regulations prior to submission of the application for review, and has not complained to the contracting entity about this within a period of ten calendar days. Expiry of the deadline as per Section 134 Subsection 2 shall remain unaffected,
2— violations of contract-awarding regulations, recognisable on the basis of the announcement, are not the subject of a complaint to the contracting entity at the latest by the closing date for applications or for the submission of offers, as stated in the announcement,
3— violations of contract-awarding regulations that are only recognisable in the contract-awarding documentation, are not the subject of a complaint to the contracting entity at the latest by the closing date for applications or for the submission of offers,
4— more than 15 calendar days have passed since receipt of the notification of the contracting entity stating that it does not wish to redress the complaint. Sentence 1 does not become invalid in the case of an application for the invalidity of the contract pursuant to Section 135 Subsection 1 Number 2. Section 134 Subsection 1 Sentence 2 shall remain unaffected”.
