      Aufgrund einer Plausibilitätsprüfung in der für die Erstellung dieser Bekanntmachung verwendeten Software mussten zwingend Auftragwerte in dieser Bekanntmachung angegeben werden. Aus den in § 39 Abs. 6 Ziffern 3 und 4 VgV genamnnten Gründen wurden nicht die geschätzten bzw. die tatsächlichen Auftragswerte angegeben, sondern fiktive, die keinesfalls den ordnungsgemäß geschätzten bzw. den tatsächlichen Auftragswerten entsprechen.

         Es wird darauf hingewiesen, dass ein Nachprüfungsantrag vor der genannten Vergabekammer nur zulässig ist,soweit der Antragsteller:

         Den geltend gemachten Verstoß gegen Vergabevorschriften vor Einreichen des Nachprüfungsantragserkanntund gegenüber der Auftraggeberin innerhalb einer Frist von 10 Kalendertagen gerügt hat, der Ablauf der Fristnach § 134 Absatz 2 GWB bleibt unberührt,

         — Verstöße gegen Vergabevorschriften, die aufgrund der Bekanntmachung erkennbar sind, spätestens bis zum Ablauf der in der Bekanntmachung benannten Frist zur Angebotsabgabe oder zur Bewerbung gegenüber derAuftraggeberin gerügt hat,

         — Verstöße gegen Vergabevorschriften, die erst in den Vergabe- und Vertragsunterlagen erkennbar sind, spätestens mit Ablauf der in der Bekanntmachung benannten Frist zur Angebotsabgabe oder zur Bewerbunggegenüber der Auftraggeberin gerügt werden,

         — der Antrag auf Einleitung eines Nachprüfungsverfahrens innerhalb von 15 Kalendertagen nach Eingang der Mitteilung der Auftraggeberin, einer Rüge nicht abhelfen zu wollen, gestellt wird.

         Satz 1 gilt nicht bei einem Antrag auf Feststellung der Unwirksamkeit des Vertrags nach § 135 Absatz 1 Nummer 2 GWG. § 134 Absatz 1 Satz 2 GWB bleibt unberührt.

         Auf die Regelungen in §§ 160, 161 GWB wird ausdrücklich hingewiesen.
