         Das Vergabeverfahren unterliegt den Vorschriften über das Nachprüfungsverfahren vor der Vergabekammer und dem Vergabesenat (§§ 155 ff. GWB).

         Ein wirksam erteilter Zuschlag kann nicht aufgehoben werden. Gerichtet werden kann ein Nachprüfungsantrag nach der Auftragsvergabe (= Zuschlagserteilung, Vertragsschluss) nur noch auf Feststellung der Unwirksamkeit des abgeschlossenen Vertrages aufgrund von § 135 Abs. 1 GWB, also wegen Verletzung der Pflicht zur Bieterinformation und Einhaltung der Wartefrist gem. § 134 GWB vor Zuschlagserteilung oder wegen unzulässig erfolgter Vergabe ohne vorherige Veröffentlichung einer Auftragsbekanntmachung im Amtsblatt der Europäischen Union (zur Nummer der hier erfolgten Auftragsbekanntmachung vgl. oben IV.2.1).

         Solche Anträge auf Feststellung der Unwirksamkeit des abgeschlossenen Vertrages sind nach § 135 Abs. 3 GWB nur innerhalb von 30 Kalendertagen nach der Information der betroffenen Bieter und Bewerber durch den öffentlichen Auftraggeber über den Abschluss des Vertrags zulässig, jedoch nicht später als sechs Monate nach Vertragsschluss. Hat jedoch der Auftraggeber – wie hier durch die vorliegende Bekanntmachung – die erfolgte Auftragsvergabe im Amtsblatt der Europäischen Union bekannt gemacht, endet die Frist zur Geltendmachung der Unwirksamkeit 30 Kalendertage nach Veröffentlichung dieser Bekanntmachung der Auftragsvergabe im Amtsblatt der Europäischen Union.
