         Zuständig für die Nachprüfung von Vergabeverfahren ist das

         Gemäß § 160 Abs. 3 Nr. 1 GWB müssen erkannte Verstöße gegen Vergabevorschriften innerhalb einer Frist von 10 Kalendertagen bei der Vergabestelle des Bundesamtes für Bauwesen und Raumordnung, Referat A 4, Straße des 17. Juni 112 in 10623 Berlin, gerügt werden, Verstöße gegen Vergabevorschriften, die sich aus diesem Bekanntmachungstext oder aus den Vergabeunterlagen ergeben, müssen innerhalb der Angebots- bzw. Bewerbungsfrist gerügt werden, § 160 Abs. 3 Nr. 2 GWB.

         Hilft die Vergabestelle der Rüge nicht ab, kann ein Antrag auf Nachprüfung beim Bundeskartellamt unter der o. g. Anschrift innerhalb von 15 Kalendertagen nach Eingang der Mitteilung des Auftraggebers, der Rüge nicht abhelfen zu wollen, gestellt werden. Der Nachrüftungsantrag ist unzulässig, soweit die Voraussetzungen von § 160 Abs. 3 GWB vorliegen.

         Die Vergabestelle weist ferner auf die Vorschriften der §§ 134, 135 GWB hin. Insbesondere sind die Fristenregelungen in § 135 Abs. 2 GWB zur Geltendmachung der in § 134 Abs. 1 GWB genannten Verstöße zu beachten.
