      Allgemeine Verfahrenshinweise für die unter III.1.1 bis III.1.3 sowie III.2.1 und III.2.2 genannten Bedingungen:

      Gem. § 50 Abs. 3 VgV und § 6b EU Abs. 3 VOB/A müssen Bewerber oder Bieter u. a. dann keine Eignungsnachweise beibringen, soweit die Zuschlag erteilende Stelle bereits im Besitz dieser Nachweise ist. Dies kann der Fall sein, wenn Bewerber oder Bieter diese Nachweise bereits in einem früheren Vergabeverfahren eingereicht haben. Wollen sich Bewerber oder Bieter in einem laufenden Vergabeverfahren auf dies Verfahrenserleichterung berufen, so haben sie die Vergabenummer desjenigen Vergabeverfahrensanzugeben, in dem sie diese Nachweise eingereicht haben. Ohne Angabe der vorgenannten Vergabenummer kann auftraggeberseits nicht nachvollzogen werden, ob und welche Nachweise von den Bewerbern oder Bietern in früheren Vergabeverfahren vorgelegt wurden.

      Zu beachten ist, dass die Nachweise, auf deren Vorliegen sich Bewerber oder Bieter berufen, für das jeweilige Vergabeverfahren aktuell sein müssen.

         Ein wirksam erteilter Zuschlag kann nicht aufgehoben werden (§ 168 Abs. 2 Satz 1 GWB). Ist der Zuschlag bereits erteilt, kann die Unwirksamkeit eines Vertrages nach § 135 Abs. 2 GWB nur festgestellt werden, wenn sie im Nachprüfungsverfahren innerhalb von 30 Kalendertagen nach der Information der betroffenen Bieter und Bewerber durch den Auftraggeber über den Abschluss des Vertrags, jedoch nicht später als 6 Monate nach Vertragsschluss geltend gemacht worden ist. Hat der Auftraggeber die Auftragsvergabe im Amtsblatt der EU bekannt gemacht, endet die Frist zur Geltendmachung der Unwirksamkeit 30 Kalendertage nach Veröffentlichung der Auftragsvergabe im Amtsblatt der EU.
